For years, Sam Hall faced discrimination and harassment as an employee at Massey Energy in West Virginia just because he is gay. As Americans who support the right of all individuals to earn a living free of fear and harassment, we are stating our concern to the executive management of Massey Energy about the reported harassment of Massey coal miner, Sam Hall. This harassment is detailed in the lawsuit that Mr. Hall filed against Massey Energy in December, 2010 which has been reported on in various media since that time. Mr. Hall has complained of a persistent pattern of harassment extending over a period of several years based on the fact that he is a gay man.
Although coming from all walks of life, we are united in our belief that all working people are entitled to decency, civility, and safety, free of verbal or physical assault, while earning a living. The reported harassment of Mr. Hall is an affront to all West Virginians. Therefore, we call upon the management of both Massey Energy to commit to ensuring the safety of all of their employees regardless of race, gender, national origin, religion or sexual orientation.
We therefore advocate that the following immediate actions be taken:
1) That the companies counsel all employees to cease any verbal or physical threats on Mr. Hall;
2) That the companies increase security to ensure Mr. Hall's safety particularly while in the mine or on any mine property, including the parking facilities;
3) That the company provides training for all employees regarding workplace safety and standards of conduct that are required in the workplace;
4) That Massey's executives take disciplinary action against any and all employees engaging in workplace harassment;
5) That Massey management advise its employees that certain workplace conduct may also constitute a violation of the criminal laws of the State of West Virginia and that it is the responsibility of Massey officials to report any acts of criminal conduct to the appropriate law enforcement authorities; and
6) That Massey management issue a public statement denouncing discrimination in any of their workplaces
